Advanced Medical Management Data Breach Lawsuit Resolved with $2.5M Settlement

A class action lawsuit claims inadequate cybersecurity on the part of Advanced Medical Management (AMM) is to blame for a May 2023 cyberattack that compromised the personal data of 319,485 individuals.
A $2.5 million settlement has been reached to resolve a proposed class action lawsuit that claimed negligent cybersecurity on the part of Advanced Medical Management, LLC (AMM) resulted in a data breach between May 10 and May 13, 2023.

The deal, which was granted preliminary approval by the court on June 25, 2024, covers an estimated 319,485 U.S. residents who had private health information exposed in the AMM data breach and were sent notification of the incident by the healthcare management company, or were subject to the notice published in the media and on AMM’s website.
To receive an AMM settlement payout, eligible class members must submit a claim form online or by mail by October 31, 2024.

In order to submit a claim, you will need the unique Notice ID and Confirmation Code found on the personalized settlement notice you should have received in the mail, the website shares. If you lost or do not know this information, you can email the settlement administrator at info@AMMCybersecuritySettlement.com to have them sent to you, the site adds.
According to the settlement website, class members may file a claim for reimbursement of out-of-pocket losses incurred on or after May 10, 2023 that are supported by documentation and reasonably traceable to the data breach, for up to $7,500 per person.
In addition, class members can submit a claim for a pro-rated share of the $2,500,000 settlement fund. Per the website, individual cash payouts are estimated to be $50, but the amount may increase or decrease depending on the total number of valid claims that are filed.
To submit a claim for a cash payment only, class members can complete the standard claim form online or simply return the tear-off claim form attached to the postcard notice they may have received in the mail.
Finally, as part of the deal, AMM has also agreed to implement certain enhanced data security measures in response to the breach, the site relays.
AMM settlement payouts will be distributed to eligible class members after the deal is granted final approval by the court following a hearing set for December 11, 2024 in Baltimore. The final approval process may be prolonged by appeals that must be resolved before payments are issued to class members, the settlement website notes.
The class action suit against AMM alleged that the company failed to prevent the 2023 cyberattack, during which a third-party threat actor reportedly gained unauthorized access to AMM’s databases and the highly sensitive information stored therein. According to the data breach lawsuit, the compromised information may have included individuals’ names, addresses, email addresses, dates of birth, Social Security numbers, driver's license numbers, and medical and health insurance details.
