Rodriguez v. Advanced Collection Bureau, Inc. et al
Filed: September 4, 2018 ◆§ 1:18cv23599
Advanced Collection Bureau is on the receiving end of a lawsuit that takes issue with an allegedly unlawful processing fee charged by the debt collector.
Florida
Advanced Collection Bureau, Inc. is on the receiving end of a proposed class action that takes issue with an allegedly unlawful processing fee charged by the debt collector.
The plaintiff received a collection notice from the defendant in September 2017 that demanded “a $5.00 processing fee for each $150 payment via credit card,” the suit says. The case argues this fee violated the Fair Debt Collection Practices Act (FDCPA) in that the defendant was attempting to collect more money from the consumer than it was entitled to. From the complaint:
“The addition of this collection fee by Defendant which was not authorized by the agreement creating the debt or permitted by law, was an attempt to collect an amount not owed by Plaintiff.”
