Advanced Call Center Technologies, LLC is facing a proposed class action lawsuit filed by a New York consumer who claims the defendant sent him a misleading collection letter.

Advanced Call Center Technologies, LLC is facing a proposed class action lawsuit filed by a New York consumer who claims the defendant sent him a misleading collection letter in violation of the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the letter referenced a debt allegedly owed to Synchrony Bank and noted that the bank “may continue to add interest and fees” to the plaintiff’s balance. The suit argues that this language is confusing to the least sophisticated consumer because it leaves him or her unsure as to whether any payment made would satisfy the account. The complaint claims the defendant should have specified the interest rate, date of accrual, and nature of any additional “fees” that might be added to the balance, allowing the plaintiff to calculate the true amount of his supposed debt.
The suit further argues that the defendant failed to clearly specify the plaintiff’s creditor, noting that the letter referenced “RE: JCPenny Credit Card Account,” but neglected to identify any entity as a “creditor.”
