Advanced Call Center Technologies, LLC is facing a proposed class action lawsuit filed by two consumers who claim the defendant sent them non-FDCPA-compliant collection letters.
New York
Advanced Call Center Technologies, LLC is facing a proposed class action lawsuit filed by two consumers who claim the defendant sent them non-FDCPA-compliant collection letters. According to the suit, the letters stated each plaintiff’s “Account Balance” and indicated an “Amount Currently Due.” However, the plaintiffs say the letters noted that their creditor “may continue to add interest and fees” to their balances without specifying the details of the added charges.
“The Letters fail to contain an explanation, understandable by the least sophisticated consumer, of any fees and interest that may cause the amount stated to increase,” the complaint reads. Without this explanation, the case continues, the plaintiffs cannot accurately determine how much the defendant claims they owe, rendering the letters misleading under the Fair Debt Collection Practices Act (FDCPA).
