Advanced Call Center Technologies Hit with Debt Collection Class Action

Per a lawsuit filed in Florida, Advanced Call Center Technologies inaccurately relayed to the plaintiff his debt verification rights under the FDCPA.

A Florida consumer has put his name on a proposed class action lawsuit in which he alleges Advanced Call Center Technologies, LLC mailed him a collection notice that “falsely and misleadingly” pronounced his verification rights under the Fair Debt Collection Practices Act (FDCPA). The plaintiff says he received a demand letter from the defendant in September 2017 containing the following language:
“If you notify this office in writing within 30 days from receiving this notice, this office will: obtain verification of the debt or obtain a copy of the judgment and mail you a copy of such judgment or verification.”
The lawsuit contends this statement is misleading and confusing because it is subject to more than one interpretation. More specifically, the case argues the statement fails to inform the plaintiff of what he needs to do to notify Advanced Call Center Technologies that the debt will be disputed, i.e., that he would “need to dispute the debt or any portion thereof, as opposed to, for example, writing to notify the defendant that the consumer cannot afford to make any payment on the debt.”
