Baliber v. Advanced Call Center Technologies, Llc
Filed: December 1, 2017 ◆§ 1:17cv7004
A proposed class action has been filed against defendant Advanced Call Center Technologies, LLC over claims that the debt collector failed to clearly convey the amount of a consumer’s alleged debt.
New York
A proposed class action has been filed against defendant Advanced Call Center Technologies, LLC over claims that the debt collector failed to clearly convey the amount of a consumer’s alleged debt. According to the complaint, the letter contained the following statements:
“Synchrony Bank may continue to add interest and fees as provided in your agreement. If you pay the balance shown above, an additional payment may be necessary to pay your account balance in full. Because of interest, late charges, credits or charges that may vary from day to day, the amount due on the day you pay may differ.”
The letter allegedly failed to specify the interest rate, the nature of the “credits or charges,” the date the fees will be applied, and any other information needed to determine the true amount owed. As a result, the suit argues, the defendant's explanation fails to meet the Fair Debt Collection Practices Act’s requirement that debt collectors clearly communicate the “amount of debt.”
