Badger et al v. Advance Stores Company Inc.
Filed: December 16, 2016 ◆§ 2:16-cv-01872-RCM
Two wheelchair-bound consumers have filed a proposed class action against Advance Auto Parts alleging violations of the Americans with Disabilities Act.
Two wheelchair-bound consumers have filed a proposed class action against Advance Auto Parts alleging some of the company’s store locations in Pennsylvania contain access barriers in parking lots and travel paths in violation of the Americans with Disabilities Act (ADA). The barriers, the lawsuit alleges, prevented the plaintiffs (and proposed class members) from having full and equal access to the defendant’s facilities and are reportedly commonplace at its locations nationwide.
“Plaintiffs’ experiences are not isolated,” the 17-page lawsuit claims. “[The defendant] has systematically discriminated against individuals with mobility disabilities by implementing policies and practices that consistently violate the ADA’s accessibility guidelines and routinely result in access barriers at [Advance’s] facilities.”
