Home security companies ADT and Safe Streets USA face a proposed class action that takes issue with their allegedly improper telemarketing practice of placing pre-recorded calls to consumers’ cell phones.
Filed in Florida, where the companies are headquartered, the case centers on the defendants’ alleged practice of placing unsolicited promotional calls in an effort to generate business. The plaintiff, a South Carolina resident, claims he received a pre-recorded call during which the defendants offered him a free security system in exchange for displaying an ADT sign on his lawn. The man alleges he never gave the companies his written consent to receive autodialed calls and argues that his privacy was violated under the Telephone Consumer Protection Act.
