WNY Lodging LLC is facing claims that it violated the Americans with Disabilities Act and various state laws by neglecting to remove access barriers that prevent blind people from being able to use its website. A blind woman is the plaintiff in a proposed class action lawsuit against the company, which operates a hotel in downtown Buffalo known as Adam’s Mark Hotel and Event Center. The woman claims she attempted to book a room at the hotel on adamsmark.com, but was unable to complete the transaction due to the various access barriers.
The suit argues that the defendant failed to implement available technology that would allow blind people using screen readers to access the site independently. It cites examples such as alternate text, accessible image maps and drop-down menus, and the use of a keyboard instead of a mouse. According to the complaint, WNY Lodging discriminates against the blind population by denying them “full and equal access to the facilities, goods, and services that [the defendant] makes available to the non-disabled public.”
