Sophie’s Cuban Cuisine Inc. and Sophie’s Cuban Cuisine Franchising, Inc. are facing a proposed class action lawsuit alleging their website violates the Americans with Disabilities Act by denying access to blind individuals.

Sophie’s Cuban Cuisine Inc. and Sophie’s Cuban Cuisine Franchising, Inc. are facing a proposed class action lawsuit alleging their website, www.sophiescuban.com, violates the Americans with Disabilities Act (ADA) by denying access to blind individuals. The plaintiff in the case, who is visually impaired, says she was unable to navigate the site to retrieve information regarding restaurant locations, hours of operation, menu items, prices, and delivery, and was therefore hindered from enjoying the goods and services offered by the defendants.
The complaint claims the site’s access barriers include a lack of alternative text and empty or redundant links, all of which prevent blind people who use screen readers from being able to interpret the site’s content and freely navigate its pages. The suit alleges the defendants “have engaged in acts of intentional discrimination” and demands that they remove the site’s access barriers.
