A New York commercial realty company and two related business have been hit with a lawsuit in New York over compliance with the American with Disabilities Act (ADA). The suit wants the court to certify a class of people who must use wheelchairs and want to use the services and accommodations offered by the defendants, one of which is a restaurant. According to the plaintiff, the defendants failed to make adequate accommodations and modifications and failed to remove certain architectural barriers. The plaintiff says the defendant’s accommodations are not accessible because, among other things, the bathrooms do not have “grab bars” and the walkway in the entrance is unlawfully unlevel.
