Account Services Collections, Inc. is on the receiving end of a proposed class action lawsuit that claims it illegally recorded consumers’ telephone calls without their knowledge. The plaintiff in the case, a California resident, says he called the defendant to discuss an alleged debt, informed the company that he intended to declare bankruptcy, and provided his social security number. At the end of the conversation, according to the complaint, he asked the defendant’s representative if the call was being recorded and was told that it was. The suit argues that under California law, the defendant was required to inform the plaintiff that the call was being recorded and failed to do so. The plaintiff claims he would never have consented to the recording because “the telephone call…concerned personal information that [the plaintiff] had not openly discussed with others.”
