A proposed class action has been filed against Account Control Technology, Inc. that takes issue with the debt collector’s alleged failure to clearly communicate the plaintiff’s “amount of debt.” According to the complaint, the defendant sent the man a collection letter that itemized his “principal balance,” “interest,” “fees & costs,” and “total balance.” Despite claiming the plaintiff owed money for interest and fees, the letter allegedly failed to indicate that his balance would continue to increase and neglected to provide him with the additional information he would need to calculate how much he truly owed on any given day. As a result, the case argues, the plaintiff was left unable to determine what he needed to pay to resolve his account.
