Brodie et al v. Speedway, LLC
Filed: January 27, 2017 ◆§ 2:17-cv-00133-RCM
A proposed class action lawsuit filed by two wheelchair-bound members of Access Now, Inc., a civil rights organization whose members have disabilities against Speedway.
A proposed class action lawsuit filed by two wheelchair-bound members of Access Now, Inc., a civil rights organization whose members have disabilities, claims Speedway, LLC, violated the Americans with Disabilities Act (ADA) by denying them and proposed class members full and equal access to its facilities as a result of “inaccessible parking lots and paths of travel.” According to the lawsuit, a number of the defendant’s facilities have parking lots and paths that for years have been inaccessible to wheelchair-bound individuals.
The plaintiffs allege that they “experienced unnecessary difficulty and risk” because of excessive slopes in Speedway’s parking facilities for its gas stations and convenience stores.
The lawsuit seeks injunctive relief, namely that Speedway remove the access barriers described in the complaint and to change its corporate policies so the problems do not reoccur.
