Aaron’s Hit with Americans with Disabilities Act Class Action in Pennsylvania
Mullen v. Aaron's Inc.
Filed: March 11, 2019 ◆§ 2:19cv263
Aaron's faces a lawsuit in which a wheelchair-reliant consumer claims parking lots and paths of travel at several locations contain accessibility barriers.
A proposed class action lawsuit claims accessibility barriers in parking lots and paths of travel at Aaron’s locations across Pennsylvania, Michigan, Colorado and Florida prevent wheelchair-reliant consumers from fully and safely accessing the company’s facilities.
Filed in Pennsylvania’s Western District, the lawsuit, citing the Americans with Disabilities Act (ADA), says the plaintiff has experienced “unnecessary difficulty and risk” during his visits to a Pittsburgh Aaron’s location within the last year. The suit attributes the alleged accessibility issues experienced by the plaintiff to “excessive slopes” in parking areas.
In addition to declaratory relief, the lawsuit asks the court for an order requiring Aaron’s to implement all reasonable modifications to address the alleged accessibility barriers found at its facilities.
