The deal covers certain individuals in the United States who, from March 1, 2023 through March 15, 2024, received telephone solicitation calls made by or on behalf of Everything Breaks.
Specifically, the class action settlement includes consumers who received two or more calls on a telephone number that appeared on the National Do Not Call Registry for at least 31 days at the time of the calls, or those who received two or more telemarketing calls in a 12-month period, with at least one received after being marked as “DNC,” “Do Not Call,” or “Already Covered” in the defendant’s records, where the telephone number appears on EBI_000029 or EBI_000030 and was obtained by the company in the same manner it obtained the plaintiff’s telephone number.
To receive an Everything Breaks settlement payout, eligible class members must submit a valid claim form online or by mail by the April 9, 2025 deadline.
Click here to begin the claims process online. When asked, “What would you like to do?” select the option that applies to you, which may involve providing the claim number and PIN located in the settlement notice that was mailed or emailed to you.
If you do not have a claim number and PIN and would still like to file a claim form, you’ll be asked to enter the telephone number to which you received a call from Everything Breaks.
Class members who submit a valid, timely claim form will receive an equal share of the $995,000 settlement fund, estimated to be between $36 and $144 per person.
“The actual amount each participating class member will receive may be more or less depending on the number of class members who submit timely, valid claims,” the settlement website says.
The Everything Breaks class action settlement was preliminarily approved by the court on December 11, 2024. The court will decide whether to grant final approval to the terms of the deal at a hearing on June 4, 2025. Settlement checks will be mailed to eligible class members only if the deal is ultimately approved and after any appeals are resolved.
According to the Everything Breaks lawsuit, the company violated the Telephone Consumer Protection Act by placing telephone solicitations to individuals with phone numbers on the National Do Not Call Registry. The defendant also ran afoul of the federal law when it continued to make these calls even after the recipient requested that they stop, the complaint alleged.
