Marshall & Melhorn has agreed to pay $800,000 to settle a proposed class action lawsuit that alleged the Ohio law firm failed to prevent a 2021 data breach that exposed the private information of more than 27,000 current and former clients.

The class action settlement, which was granted preliminary approval by the court in August 2024, covers all United States residents who received a notice informing them that their private information was compromised in the Marshall & Melhorn data breach.
The class action lawsuit claimed the defendant failed to employ reasonable cybersecurity measures, which allowed hackers to gain unauthorized access to its computer systems between August 2021 and September 14, 2021 and steal consumers’ names, Social Security numbers, financial information and more.
To receive a Marshall & Melhorn settlement payout, eligible class members must submit a valid claim form online or by mail by December 23, 2024.

Class members can file a claim to receive a $70 cash payment, which may be increased or decreased on a pro-rated basis. Covered individuals can also submit a claim for up to $5,000 for reimbursement of documented out-of-pocket losses reasonably traceable to the Marshall & Melhorn data breach, such as losses relating to fraud or identity theft, expenses associated with freezing or unfreezing credit, or credit monitoring costs.
Marshall & Melhorn settlement payouts will be distributed to eligible class members after the deal is granted final approval by the court. A final approval hearing is scheduled for January 13, 2025.
