$8.9 Million Elekta Settlement Resolves Data Breach Lawsuit

Elekta faces a class action over a ransomware attack that reportedly compromised all of the personally identifiable patient information housed in its cloud-based data storage system.
An $8.9 million settlement has been reached to resolve a proposed class action lawsuit filed over an April 2021 breach of Elekta, Inc.’s data storage system, which impacted patients’ names, Social Security numbers, medical histories and other private information.

According to the initial class action lawsuit, hackers gained access to files and records belonging to healthcare providers that used Elekta’s software, including Northwestern Memorial Healthcare, Renown Health, St. Charles Health System, Carle Health, Cancer Centers of Southwest Oklahoma, LLC, Lifespan, Southcoast Health and Yale New Haven Health.
You may be eligible to receive compensation from the deal if your information was accessed or potentially accessed in connection with the Elekta data breach, including if you were mailed a notification letter regarding the incident from any of the company’s healthcare customers.
Class members have until December 26, 2024 to file a claim form for Elekta settlement benefits.
Submit your claim form online by heading to this page. To submit a claim, you will have to enter your settlement claim ID number, which can be found on the settlement notice you may have received in the mail.

Class members who file a timely, valid claim form will be able to receive up to $5,000 for any documented, out-of-pocket losses reasonably traceable to the Elekta data breach.
Covered Illinois residents who attest that they shared their genetic information with either Elekta or co-defendant Northwestern Memorial Healthcare can also receive a pro-rated cash payment for damages under the Illinois Genetic Information Privacy Act (GIPA). Court documents say that GIPA payments will be capped at $1,000 per person.
Class members who are not eligible to receive a GIPA payment can submit a claim for a pro-rated cash payment of up to $1,000.
The Elekta settlement received preliminary approval from the court in August 2024. The court will hold a final approval hearing on January 6, 2025 to determine whether to grant final approval to the settlement.
Class members will receive their settlement benefits only if the deal receives final approval and after any appeals are resolved.
