$61 Million Progressive Settlement Resolves Michigan Total Loss Class Action Lawsuit

Progressive has agreed to pay $61 million to settle two class actions that claimed it illegally failed to include certain fees in total loss claim payments made to policyholders in Michigan.

The deal covers anyone who was insured under a Progressive Marathon automobile insurance policy in Michigan, made a first-party claim for physical damage or theft to a vehicle, and received a total loss claim payment between July 18, 2013 and July 22, 2024.
The settlement also covers anyone who was insured under a Progressive Michigan automobile insurance policy in Michigan, made a first-party claim for physical damage or theft to a vehicle, and received a total loss claim payment from July 18, 2016 through July 22, 2024.
Class members have until December 6, 2024 to submit a claim form for settlement benefits, which can be done by mail or online through the official settlement website, UbillusPerryTotalLossClassAction.com.
A Progressive claim form can be filed online on this page. To begin filling out your claim form, enter your zip code and the unique ID number found in the settlement notice you received.
If you did not receive or have misplaced or discarded your settlement notice, you can still submit a claim without a unique ID number on this page.
Class members who submit a timely, valid claim form will receive either 45, 55 or 65 percent of any unpaid sales tax, title, or vehicle registration fees, the class action settlement website states. The percentage will depend on how much is approved for attorneys’ fees, the settlement website says.

The Progressive total loss settlement was granted preliminary approval in July 2024. Checks will be distributed to class members only after the court grants final approval to the settlement and any appeals are resolved. A final approval hearing was held on November 21, 2024.
The $61 million settlement resolves two class action lawsuits filed in Michigan state court in 2019 and 2022, respectively. Both cases alleged Progressive Marathon and Progressive Michigan breached the terms of their insurance policies by failing to include sales tax, title fees, and registration transfer fees in their calculations of actual cash value when paying full total loss payments to Michigan insureds.
