Hapy Bear Surgery Center has agreed to pay $607,500 to settle a proposed class action lawsuit filed over a data breach that targeted the dental clinic in December 2023.

The settlement covers more than 109,000 people whose personal identification information was stored in Hapy Bear Surgery Center’s systems at the time of the December 27, 2023 cybersecurity incident and who were impacted by the data breach.
According to the class action lawsuit against Hapy Bear Surgery Center, the dental clinic failed to take proper steps to protect the data in its care, which led to the exposure of names, addresses, medical information, health insurance details, Social Security numbers and driver’s license numbers.
Class members can now file a claim form for compensation and other benefits at the official website for the deal, HBSCDataSettlement.com.

The deadline to file a Hapy Bear Surgery Center claim form is February 4, 2025.
As part of the deal, eligible individuals who submit a valid, timely claim can get up to $500 for documented ordinary, out-of-pocket losses and up to $7,500 for extraordinary, out-of-pocket losses related to the breach. Class members can also claim $25 for each hour they spent responding to the incident, with a cap of four hours.
Covered data breach victims can also get two years of credit monitoring services. Class members who are California residents are also eligible to receive an additional payment of $50.
“To claim each type of remedy, you must provide information and documentation with the Claim Form, as described on the Claim Form,” the settlement site says.
The court granted preliminary approval to the Hapy Bear Surgery Center settlement in October 2024, and a final approval hearing is set for February 24, 2025. Class members should expect to receive their payments and benefits sometime after the court grants final approval to the deal and any appeals are resolved.
