$6.5M PillPack Settlement Resolves Class Action Lawsuit Over Alleged Spam Calls

PillPack LLC is facing a lawsuit from a Washington resident who claims to have received unsolicited promotional calls from the online pharmacy.
PillPack has agreed to pay a $6.5 million settlement to resolve a proposed class action lawsuit that sought to hold the online pharmacy accountable for allegedly placing unlawful prerecorded telemarketing calls to consumers without consent.

The deal covers anyone in the United States who received a prerecorded voice call promoting PillPack’s services as part of the PillPack Performance Media Campaign between March 13, 2018 and June 16, 2019; whose call was live-transferred by Performance Media or its agents to a PillPack call center on the DNIS 866-298-0058; and whose cell phone number was not obtained through RewardZoneUSA.com, NationalConsumerCenter.com, FindDreamJobs.com, InstantPlaySweepstakes.com, StartACareerToday.com, SamplesAndSavings.com, SweepstakesADay.com, SurveyVoices.com or FinanceDoneRight.com between June 19, 2017 and May 3, 2019, before the dates of the calls.
To receive a pro-rated share of the $6,500,000 settlement fund, class members must submit a valid claim form online or by mail by January 20, 2025.

In order to submit a claim online, you will need to provide your unique Claim ID—found on the personalized settlement notice you should have received via mail or email—or the phone number at which you received calls from PillPack, the website relays.
According to the site, individual PillPack settlement payouts could range between $600 and $1,500 per person, though the final amount will depend on the total number of timely, valid claims that are submitted.
The PillPack settlement was preliminarily approved by the court on September 17, 2024, and the parties now await a final approval hearing set for April 18, 2025. Cash payouts will be issued to eligible class members only after the deal receives final approval, the website notes.
The lawsuit against PillPack alleged the company violated the federal Telephone Consumer Protection Act by failing to obtain express written consent from consumers before its agents placed telemarketing calls. The class action suit was filed in 2019 by a man who claimed to have received unsolicited calls even though he had no prior relationship with the online pharmacy and that his phone number has been listed on the National Do Not Call registry since 2010.
