$6 Million UNITE HERE Settlement Resolves Data Breach Lawsuit Over October 2023 Cyberattack

UNITE HERE faces a class action after an October 2023 cyberattack compromised the personal data of more than 791,000 current and former union members.
UNITE HERE has agreed to pay a $6 million settlement to resolve a consolidated class action lawsuit that claimed the New York-based labor union failed to protect the personal information of more than 791,000 people during an October 2023 data breach.

The settlement agreement with the hospitality, food service and gaming labor union, which was preliminarily approved by the court on January 10, 2025, covers anyone in the United States whose private information was potentially compromised as a result of the data breach.
To receive a UNITE HERE settlement payout, eligible class members must submit a valid claim form online or by mail by the April 28, 2025 deadline.

According to the UNITE HERE settlement website, class members who submit a timely, valid claim form are eligible to receive two years of complimentary credit monitoring protection services.
In addition, class members may file a claim for up to $5,000 in reimbursement for documented out-of-pocket expenses that were incurred as a result of the data breach, the site says. This may include unreimbursed bank or credit card fees, long-distance phone charges, data charges, postage and/or credit or identity theft monitoring services purchased between October 20, 2023 and April 28, 2025, the website explains.
Class members can also submit a claim to receive a pro-rated share of the $6,000,000 settlement fund, regardless of whether they file a claim for out-of-pocket losses, the site relays. Per the website, individual payout amounts will be determined by what funds remain after payment of out-of-pocket expense claims, credit monitoring costs, attorneys’ fees, service awards and administration fees.
The settlement website adds that cash payout amounts are subject to adjustment depending on the total number of valid claims that are submitted.
The court will decide whether to grant final approval to the terms of the UNITE HERE class action settlement during a hearing set for May 12, 2025. Settlement benefits will be issued to eligible class members only if the deal is ultimately approved, and after any appeals are resolved.
According to the UNITE HERE lawsuit, an unauthorized third party gained access to the union’s computer system and certain personal information stored therein on October 20, 2023. The data breach suit shared that current and former members’ names, Social Security numbers, dates of birth and medical information may have been exposed as a result of the incident.
