$5.1M Magid Glove and Safety Settlement Resolves Class Action Suit Over Alleged Biometrics Violations

Magid has agreed to pay a more than $5.1 million settlement to resolve a class action that alleged the company unlawfully collected workers’ biometric data.

Magid Glove and Safety Manufacturing Company has agreed to pay a more than $5.1 million settlement to resolve a proposed class action lawsuit that alleged the personal protective equipment supplier unlawfully collected workers’ fingerprints or facial, iris or retina scans.

The deal, which was preliminarily approved by the court on August 30, 2024, covers individuals who, between January 8, 2016 and August 30, 2024, scanned their finger to clock in or out, and/or had their temperatures scanned, at Magid’s Romeoville, Illinois facility.
The settlement website notes that class members who are current or former employees will automatically be included in the deal and do not need to submit anything to be eligible to receive a settlement rebate. Class members who are or were temporary workers at Magid must file a claim form online or by mail by November 19, 2024 to receive a share of the $5,175,000 settlement fund.
To file a Magid claim form online, head to this page or use the claim form link that was included in the personalized notice you may have received via email or text message since September 20, 2024. Alternatively, to submit a claim form by mail, you can download the PDF claim form or return the paper copy with pre-paid postage that was attached to the notice you may have received in the mail in the past month.
The website shares that depending on the nature of your claim, you may need to complete an IRS Form W-9 in order to fulfill tax reporting requirements related to your settlement payment and avoid backup tax withholding. To complete the form online, head to this page.
Each class member will need their unique Claim Login ID and PIN in order to submit a Magid settlement claim form and/or access the Form W-9 online.
Although precise individual payout amounts are unknown, the website estimates that class members who had their temperatures scanned may receive up to $135.26 each. Those who used fingertip-scan timeclocks may be eligible to receive up to $3,244.38, the site relays. Class members who fall into both categories will be eligible to receive both cash benefits, the site shares.
The parties now await a final approval hearing for the Magid BIPA settlement on December 20, 2024 in Illinois. Cash payments will be issued via check to eligible class members if the court grants final approval to the deal, and after any appeals are resolved.
The class action lawsuit against Magid claimed the company violated the Illinois Biometric Information Privacy Act (BIPA), which prohibits businesses from capturing, storing or using an individual’s biometric data—including fingerprints and facial or eye scans—without first providing proper notice and obtaining written consent.
