The plaintiff claims he never provided express consent for 5 Star Roofing and Restoration to call his cell phone.

A proposed class action has been filed in Alabama against 5 Star Roofing and Restoration, LLC in which the plaintiff seeks redress for the company’s alleged practice of placing unsolicited telemarketing calls to consumers’ cell phones. The plaintiff alleges he began receiving calls from the defendant in April 2018 despite never providing 5 Star Roofing with consent to contact him. The calls did not contain a mechanism by which the plaintiff could opt out of receiving future communications, the case says.
“In order to reach more customers, [the defendant] used an invasive and illegal method of advertising: unsolicited [telemarketing] via pre-recorded message and/or automatic dialer known as ‘Robocalling,’” the lawsuit reads.
