Pinnacle Propane has agreed to a $490,000 settlement that will resolve a class action over a December 2022 data breach.
Pinnacle Propane, LLC has agreed to a $490,000 settlement that will resolve a proposed class action lawsuit over a December 2022 data breach that reportedly exposed current and former employees’ names, addresses, and Social Security numbers.

The class action settlement received preliminary approval from the court in June 2024 and will provide compensation to anyone whose private information was compromised or potentially compromised in the data breach disclosed by Pinnacle Propane in June 2023.

Class members have until December 13, 2024 to file a claim form for settlement benefits.

Covered individuals who file a valid, timely claim form can recover up to $2,000 for out-of-pocket losses incurred as a result of the Pinnacle Propane data breach. Claims for compensation must be submitted with supporting documentation.
“These Out-of-Pocket Losses incurred as a result of the Data Incident may include, without limitation, expenses unreimbursed costs associated with fraud or identity theft, including professional fees and fees for credit repair services and miscellaneous expenses, such as (i) notary, (ii) fax, (iii) postage, (iii) copying, (iii) mileage, and (iv) long-distance telephone charges, as well as costs for credit monitoring costs or other mitigative services that were incurred on or after December 4, 2022,” the settlement site says.
Class members can also submit a claim to receive $40 for each hour they spent mitigating the effects of the data breach, with a cap of six hours, as well as three years of free credit monitoring services.
Alternatively, in lieu of making a claim for out-of-pocket losses, lost time or credit monitoring services, class members can opt to receive a $100 cash payment.
Class members will receive their settlement benefits after the Pinnacle Propane data breach settlement is granted final approval from the court and any appeals are resolved. A final approval hearing is set for December 19, 2024.
The data breach lawsuit against Pinnacle Propane was initially filed in July 2023 and claimed that cybercriminals gained unrestricted access to employees’ private information because the Texas-based propane supplier failed to maintain reasonable cybersecurity measures.
