$43 Million Progressive Settlement Resolves Georgia Total Loss Claim Lawsuit

A $43 million settlement has been reached to resolve a proposed class action lawsuit that claimed Progressive Mountain Insurance Company and Progressive Premier Insurance Company of Illinois systematically undervalued total loss claims made by Georgia policyholders.

The deal covers roughly 151,485 people who made a first-party claim on an insurance policy issued by Progressive Mountain to a Georgia resident, submitted between October 11, 2015 and February 18, 2025, or issued by Progressive Premier to a Georgia resident, submitted between June 8, 2016 and February 18, 2025, where Progressive determined the vehicle was a total loss and based its claim payment on an instant report from Mitchell International, Inc. that applied a projected sold adjustment to at least one comparable vehicle.
Court documents indicate that direct notice of the Progressive settlement was sent to class members around March 31, 2025.

According to the initial Progressive lawsuit, the insurer contracted with Mitchell to use software that allegedly applied “arbitrary and unexplained” deductions called projected sold adjustments when determining settlement values for total loss vehicle claims in Georgia. The complaint alleged these deductions violated a Georgia law that requires insurance companies to pay policyholders for the actual cost required to purchase a comparable vehicle when settling total loss claims.
Class members do not need to do anything to receive a Progressive settlement payout, and checks will be automatically mailed to the address on file with the company. If your mailing address has changed or if you prefer to receive payment electronically through PayPal, Venmo or direct deposit, contact the settlement administrator.
Covered individuals are entitled to a pro-rated share of the $43 million class action settlement fund based on the value of their total-loss vehicle. The average payout is estimated to be about $173 per person, the settlement website says.

The court granted preliminary approval to the Progressive settlement on February 18, 2025. A final approval hearing is slated for May 15 of this year. It is typically after a class action settlement receives final approval from the court, and any appeals or objections are resolved, that compensation begins to go out to class members.
