As part of the deal with Rise Interactive, eligible class members may file a claim for reimbursement of up to $250 per person for documented out-of-pocket losses that have not been previously reimbursed and were “more likely than not” incurred as a result of the incident, the settlement website relays.
In addition, consumers can submit a claim for an estimated $50 cash payout, the site says. Per the settlement agreement, final payment amounts may be adjusted on a pro rata basis, depending on the total number of valid claims that are filed.
A hearing is set for March 11, 2025 in Chicago, at which the court will determine whether to grant final approval to the terms of the deal. Settlement payouts are typically issued to class members after a deal is ultimately approved and any appeals are resolved.
The lawsuit against Rise Interactive Media & Analytics claimed that negligent cybersecurity on the part of the company, which provides digital marketing for Edgepark Medical Supplies, resulted in unauthorized access to Rise’s IT network in November 2022. According to the data breach suit, the incident may have compromised individuals’ names, email addresses, phone numbers, provider information, diagnoses, expected delivery dates and health insurance details.
