$4.3 Million Upstream Rehabilitation Settlement Resolves Lawsuit Over 2023 Data Breach

Upstream Rehabilitation faces a class action over a cyberattack that reportedly occurred in early 2023 and compromised the personal information of current and former patients.
A $4.3 million settlement has been reached to resolve a proposed class action lawsuit that alleged Upstream Rehabilitation left patients’ private information vulnerable to cybercriminals during a 2023 data breach.

The $4,304,898 deal covers anyone in the United States whose personal information was exposed to unauthorized third parties as a result of the Upstream data breach that occurred between January 24 and January 31, 2023, and between February 3 and February 9, 2023.
Class members can now file a claim form for compensation and other benefits at the official settlement website, UpstreamDataSettlement.com.
To file an Upstream data breach settlement claim form, head to this page and enter your unique ID and PIN found in the settlement notice you should have received. If you don’t have a unique ID and PIN, you can download a PDF claim form to print and return by mail.
The deadline to submit a claim form is January 30, 2025.

According to the settlement site, covered individuals who file a timely, valid claim form can get reimbursed up to $5,000 for documented, out-of-pocket expenses “fairly traceable” to the Upstream data breach. Class members can also make a claim for a pro-rated share of the settlement fund. Cash payments are estimated to be no less than $50 per claimant.
Covered individuals are also eligible to claim three years of free financial account monitoring services.
Upstream settlement payments will be distributed sometime after the court grants final approval to the deal and any appeals are resolved. A final approval hearing is scheduled for February 24, 2025. The deal was preliminarily approved in October 2024.
A consolidated class action complaint against Upstream claimed the outpatient physical therapy provider’s deficient cybersecurity measures led to the exposure of current and former patients’ full names, dates of birth, contact information, demographic information, medical information, health insurance information and Social Security numbers.
