$3.57 Million Settlement Resolves Similasan Eye Drop Class Action Lawsuit

A proposed class action alleges Similasan has illegally marketed its eye drops as homeopathic drugs capable of curing a range of ophthalmic conditions.

Similasan has agreed to pay $3,575,000 to settle a proposed class action lawsuit that claimed the company illegally marketed eye drops as homeopathic drugs without appropriate approvals from the United States Food and Drug Administration (FDA).

The proposed deal awaits preliminary court approval. If approved, the Similasan class action settlement would cover anyone in the United States or its territories who purchased the following products for personal use and not for resale from September 11, 2017 until the date the deal receives preliminary approval:
- Similasan Dry Eye Relief;
- Similasan Complete Eye Relief;
- Similasan Allergy Eye Relief;
- Similasan Kids Allergy Eye Relief;
- Similasan Red Eye Relief;
- Similasan Pink Eye Relief;
- Similasan Kids Pink Eye Relief;
- Similasan Aging Eye Relief;
- Similasan Computer Eye Relief;
- Similasan Stye Eye Relief;
- Similasan Pink Eye Nighttime Gel;
- Similasan Dry Eye Nighttime Gel;
- CVS Pink Eye Drops;
- Walgreens Stye Eye Drops;
- Walgreens Pink Eye Drops; and
- Walgreens Allergy Eye Drops.
Per the settlement agreement, the CVS and Walgreens-brand products are made with ingredients supplied by Similasan, and substantially similar to those in the Similasan products.
To receive compensation from the deal, class members must submit a valid, timely claim form by mail or online when the official settlement website goes live.

According to court documents, class members who file a Similasan claim form with valid proof of purchase will be eligible to receive $2.50 for each covered product they purchased during the relevant time period. Class members who submit a claim form without valid proof of purchase will be eligible to receive $2.50 for up to four covered products purchased during the relevant time period. Claims are limited to one per household.
Typically, covered consumers begin to receive benefits from a class action settlement only after the deal receives final approval from the court and any appeals or objections are resolved.

The Similasan class action lawsuit, initially filed in September 2023, alleged that the eye drops at issue were deceptively advertised as homeopathic drugs capable of curing a number of ophthalmic symptoms, including watery eyes, sensation of grittiness, redness, strain and burning. The complaint claims that the eye drops, without FDA approval recognizing the products as safe and effective, were no more than adulterated drugs and, therefore, illegal to sell.
