$3.25M Progressive Settlement Resolves Class Action Lawsuit Over Years-Long Data Breach

A class action claims lax data security practices on the part of Progressive resulted in a “massive,” years-long data breach that compromised the personal information of roughly 347,100 individuals.
A $3.25 million settlement has been reached to resolve a proposed class action lawsuit that alleged negligent data security practices on the part of Progressive Casualty Insurance Company resulted in a data breach that reportedly compromised the personal information of approximately 350,000 people.

According to the lawsuit against Progressive, the company was notified on May 19, 2023 that certain call center representatives employed by a third-party service provider had improperly disclosed the workers’ Progressive access credentials to individuals not employed by the vendor. As a result, the class action suit said, the unauthorized parties may have had access to the private data of Progressive customers who contacted the call center, including their names, dates of birth, email addresses, Social Security numbers, driver’s license numbers and financial details such as account numbers and credit or debit card numbers.
The $3,250,000 class action settlement covers anyone in the United States who Progressive identified as potentially having had their personal information viewed by an unauthorized individual because of the security event experienced by third-party call center vendor TTEC between May 2021 and May 2023.
To receive a Progressive settlement payout, eligible class members must file a valid claim form online or by mail by February 18, 2025.

According to the settlement website, class members who submit a valid, timely claim form will be eligible to receive three years of credit monitoring and insurance services at no cost.
In addition, the site says, consumers can file a claim for up to $5,000 in compensation per person for losses incurred as a result of the data breach and that are supported by documentation.
Class members who wish to forego compensation for monetary losses may instead submit a claim for a pro-rated cash payout, the website shares. Individual payment amounts will be determined on a pro rata basis depending on the total number of valid claims that are filed, the site adds.
The settlement agreement with Progressive was preliminarily approved by United States District Judge Patricia A. Gaughan on September 19, 2024. The parties now await a hearing set for February 25, 2025, at which the court will decide whether to grant final approval to the terms of the deal.
The website notes that payments will be issued to eligible class members only after the court ultimately approves the settlement and any appeals are resolved.
