According to the cold cut recall settlement website, class members who submit a timely, valid claim with proof of purchase of a qualifying product are entitled to reimbursement of the full purchase price for each unit they bought.
Consumers who file a valid claim without proof of purchase are eligible to receive the average retail price for up to two qualifying products claimed per household, the site says.
If a class member or anyone in their household received reimbursement from the Boar’s Head recall, their settlement payment will be reduced by the amount they’ve already received, the website notes.
Per the site, Boar’s Head settlement payment amounts are subject to adjustment on a pro rata basis, such that the total amount paid to claimants equals the amount of available funds.
The parties now await a final approval hearing set for August 13, 2025, at which the court will decide whether to officially green-light the terms of the settlement agreement.
Cash payouts will be issued to eligible class members only if the deal receives final approval, and after any appeals are resolved, the website relays.
Boar’s Head initially recalled approximately 207,528 pounds of ready-to-eat liverwurst and other deli meat products on July 26, 2024. According to the announcement posted by the USDA’s Food Safety and Inspection Service (FSIS), the voluntary recall was issued after a sample from a retail store in Maryland tested positive for listeria.
Days later, the recall was expanded to include 71 products—an additional seven million pounds of ready-to-eat meat and poultry items—produced between May 10 and July 29 of last year under the Boar’s Head and Old Country brand names, the FSIS reported.
The Boar’s Head class action lawsuit alleged that the company failed to warn consumers that its deli meat products were potentially contaminated with dangerous bacteria. According to the class action suit, reasonable shoppers would not have purchased the items had the contamination risk been disclosed properly.
