$3.15M Azura Vascular Care Settlement Resolves Data Breach Lawsuit Over 2023 Cyberattack

A class action seeks to hold Azura Vascular Care responsible for a September 2023 data breach that reportedly exposed the private information of 348,000 individuals.
A $3.15 million settlement has been reached to resolve a proposed class action lawsuit that alleged negligent cybersecurity on the part of Azura Vascular Care resulted in a data breach between September and October 2023.

The settlement agreement with Fresenius Vascular Care, Inc.—which does business as Azura—covers a class of all individuals whose personal information may have been compromised in the data breach, including those who were sent notice of the incident.
Eligible class members must submit a valid claim form online or by mail by June 30, 2025 to receive Azura settlement benefits.

According to the official Azura settlement website, class members may file a claim to receive up to $10,000 in reimbursement per person for unreimbursed expenses and losses that were incurred as a result of the data breach and are supported by reasonable documentation.
In lieu of this payment, consumers can elect to receive a flat, pro-rated cash payout, the site says. Final payout amounts are subject to adjustment in the event the net settlement fund has extra or insufficient funds, the website adds.
In addition, Azura has enhanced its data security protocols to better safeguard its network, the site shares.
The settlement was preliminarily approved by the court on February 24, 2025. It is now up to the court to decide whether to grant final approval to the terms of the deal at a hearing set for June 16, 2025. Typically, settlement benefits are issued to eligible class members only if the deal receives ultimate court approval, and after any appeals are resolved.
The Azura class action lawsuit claimed that cybercriminals gained access to Azura’s network between September 27 and October 9, 2023, exposing the private information of thousands of individuals, including current and former patients. Specifically, the Azura data breach potentially compromised names, Social Security numbers, home addresses, dates of birth, demographic and contact information, driver’s license and state ID numbers, provider identification numbers, insurance policy and guarantor details, diagnosis and treatment data and other information from medical or billing records.
