The 56-page data breach lawsuit says an unauthorized third party was able to download files containing personal information from Baxter’s network around June 10 of this year as a result of the company’s alleged failure to use reasonable cybersecurity procedures. A report provided to the Texas Attorney General’s Office reveals that the incident exposed names, addresses, medical information, dates of birth and other personal details.
According to the case, the defendant’s failure to encrypt or redact the sensitive data in its care has placed affected customers and employees at a heightened risk of identity theft and fraud.
The plaintiff, a Mississippi resident and former employee of the medical equipment manufacturing company, says it wasn’t until August 8 that Baxter informed her that her private data had been accessed and compromised. The defendant omitted “critical facts” from its notice letter to affected individuals, the case claims, arguing that the letter failed to mention the root cause of the breach, the vulnerabilities exploited and what steps, if any, have been taken to prevent a future cyberattack.
“Without these details, [the plaintiff’s] and class members’ ability to mitigate the harms resulting from the data breach is severely diminished,” the Baxter data breach lawsuit asserts.
The filing contends that Baxter had a legal duty to protect individuals’ data from unauthorized disclosure and is liable for damages and out-of-pocket costs incurred by victims as a result of the breach.
The Baxter lawsuit looks to represent anyone who the company has identified as being among those individuals impacted by the data breach, including all who were sent notice of the incident.
