A $2.1 million settlement has been reached to resolve a class action filed over the Cummins Behavioral Health Systems data breach.
A $2.1 million settlement has been reached to resolve a proposed class action lawsuit that alleged inadequate cybersecurity measures by Cummins Behavioral Health Systems, Inc. resulted in a 2023 data breach.

The deal, which received preliminary approval from the court on July 23, 2024, covers anyone in the United States to whom Cummins Behavioral Health Systems sent a notice concerning the security incident. The Cummins Behavioral Health Systems data breach took place between February 2 and March 9, 2023 and reportedly compromised the private information of more than 157,600 individuals.
Class members can obtain a cash payment or a free trauma screening by submitting a valid, timely claim form through the official settlement website, CumminsDataSettlement.com.

Covered individuals are eligible to receive reimbursement of up to $500 for documented, out-of-pocket “ordinary” losses incurred as a result of the Cummins data breach, such as fees for credit reports, credit monitoring or other identity theft insurance products.
Class members can also get reimbursed up to $5,000 for documented, out-of-pocket “extraordinary” losses. These could include losses resulting from fraud, identity theft or other misuses of personal information compromised in the breach, the settlement site states.
In addition, the Cummins settlement will provide class members who file a valid claim form with $25 for each hour they spent dealing with issues related to the cyberattack, with a cap of up to three hours.
Alternatively, eligible data breach victims can opt for either a $65 cash payout or a free trauma screening from Cummins Behavioral Health Systems.
The initial Cummins Behavioral Health Systems class action lawsuit was filed in August 2023, several months after the nonprofit says it discovered that a cybercriminal had left a ransom note within its computer environment. According to the HIPAA Journal, the unauthorized individual stole names, addresses, dates of birth, Social Security numbers, health insurance information and payment card information.
