A Mississippi resident has filed a class action against 1st Financial Bank, USA claiming it violated the Telephone Consumer Protection Act (TCPA) by using automatic telephone dialing equipment to contact proposed class members’ cell phones. Further, the complaint alleges that when the defendant is unable to reach debtors by phone, the bank resolves to locate new numbers independently through “unreliable skip tracing methods or through number trapping”—all allegedly done without consumers’ consent.
