The deal covers all United States residents who use their cell phone as their residential telephone line and who were sent text messages by Jefferson Dental after making a “STOP” request, and after having placed their cell phone number on the National Do-Not-Call Registry between May 17, 2019 and May 17, 2023.
The number of class members is estimated to be 10,334 people, the settlement website shares.
To receive a share of the $1,000,060 settlement fund, class members must file a claim form online or by mail by December 9, 2024.
To submit a claim form online or to download a PDF claim form to return by mail, head to this page. Alternatively, you can complete the pre-filled claim form that was included in the postcard notice you may have received via mail or email, or you may call the settlement administrator at 1-800-543-4459 to request a paper copy to be sent to you.
In order to submit a Jefferson Dental claim form, you will need the unique Notice ID and PIN found on the notice you may have received.
The website shares that class members who file a valid claim by the deadline will be eligible to receive an estimated $57 cash payment, which, if the deal is ultimately approved by the court, will be issued by check within 60 days of the date the settlement goes into effect.
The parties now await the court’s final approval of the terms of the deal. Settlement benefits will be distributed to eligible class members if approval is granted and after any appeals are resolved. According to the settlement website, the earliest that cash benefits may be issued is mid-March 2025.
The class action suit against Jefferson Dental claimed the company violated the Telephone Consumer Protection Act, a federal law that prohibits businesses from sending promotional texts without first securing a recipient’s express written consent to be contacted. The lawsuit alleged Jefferson Dental violated consumers’ protected privacy rights by continuing to send “text message spam” even though the recipients had requested to opt out of any future contact.
