$1.7M Intoxalock Settlement Resolves California Phone Call Privacy Lawsuit

The company behind Intoxalock has agreed to pay more than $1.7 million to settle a proposed class action lawsuit that claimed it recorded telephone calls without consumers’ consent in violation of California law.

The class action settlement includes anyone listed in Intoxalock’s records who has a California address and/or a telephone number bearing a California prefix and had one or more telephone conversations with an Intoxalock sales representative at any time between May 18, 2021 and February 8, 2022.
To receive a cash payment from the Intoxalock settlement, class members must submit a claim form online or by mail by March 12, 2025.

Class members who file a valid, timely claim form are eligible to receive a pro-rated share of the $1,747,500 settlement fund after certain fees and expenses are deducted. Cash payments will be capped at $5,000 per claimant.
The deal received preliminary approval from the court in October 2024. According to the settlement website, Intoxalock settlement payments will be distributed sometime after the court grants final approval to the deal and any appeals are resolved. A final approval hearing is scheduled for March 3, 2025.
“If the Settlement receives final approval, payments may be made as soon as June 16, 2025 but, depending on what happens in the case, payments could be delayed,” the site states.
The lawsuit against Intoxalock was filed by two California residents who claim they had no idea their calls with the company were being “routinely and intentionally” recorded. Intoxalock, which sells, leases and services ignition interlock devices, was accused of violating the California Invasion of Privacy Act—a state law that prohibits the recording of certain telephone communications without the consent of all parties involved.
