The $1,600,000 deal covers anyone in the United States whose protected health and/or personally identifiable information was exposed to unauthorized third parties as a result of the data breach discovered by Nonstop around December 22, 2022. According to the lawsuit against Nonstop, the company began to notify impacted individuals about the data breach in February 2023.
Class members must submit a valid claim form by the February 12, 2025 deadline to be eligible to receive Nonstop Administration and Insurance Services class action settlement benefits.
You can file a claim form online on this page. To file a settlement claim online, you will need to provide your unique class member ID, which is typically found in the settlement notice you should have received.
Alternatively, you may submit a claim by mail by downloading a PDF claim form or calling the settlement administrator at 833-627-7774 to request a paper copy.
As part of the deal with Nonstop, class members can submit a claim for reimbursement for up to $5,000 per person for out-of-pocket losses that were incurred between December 22, 2022 and February 12, 2025 and are “reasonably traceable” to the data breach, the website says.
In lieu of reimbursement, eligible consumers may file a claim for an alternative cash payout of approximately $50, the site relays. Per the website, individual payout amounts will be subject to pro-rated adjustment based on what funds remain after the payment of all valid out-of-pocket loss claims, administrative expenses, attorneys’ fees and service awards.
On top of the aforementioned cash benefits, class members who resided in California between December 22, 2022 and February 12, 2025 are eligible to receive an additional $100 payout, the settlement site shares. This payment may decrease on a pro rata basis, the website notes.
Lastly, Nonstop has also agreed to take, or has already taken, certain measures to further secure its computer systems in response to the cyberattack, the site adds.
The settlement agreement was preliminarily approved by the court on October 15, 2024. Next, the court will determine whether to grant final approval to the terms of the deal at a hearing set for March 18, 2025 in San Francisco.
Typically, class action settlement payouts are issued to eligible class members after a deal is approved and any appeals are resolved.
