$1.6M Hilb Group Settlement Resolves Lawsuit Over 2022-2023 Data Breach

The Hilb Group Operating Company faces a class action over a cyberattack announced in November 2023 that compromised tens of thousands of individuals’ personal data.
A $1.6 million settlement has been reached to resolve a proposed class action lawsuit that claimed insurance agency Hilb Group negligently failed to prevent a data breach in late 2022 and early 2023 that reportedly compromised the private information of more than 100,000 people.

The $1,600,000 class action settlement, which was granted preliminary approval by the court on August 15, 2024, covers 108,954 United States residents who received notice from Hilb Group or on its behalf that their personal information may have been impacted by the data security incident that occurred between December 1, 2022 and January 12, 2023.
To receive a Hilb Group settlement payout, eligible class members must file a valid claim form online or by mail by December 13, 2024.

In order to submit a claim online, you will need your unique Class Member ID, which can also be found on the postcard notice.

According to the settlement website, class members can file a claim for reimbursement of documented out-of-pocket losses incurred on or after December 1, 2022 that have not been reimbursed previously and are “reasonably traceable” to the data breach, for up to $5,000 per person.
In addition, the site says, class members who submit a valid claim form by the deadline may be eligible to receive an estimated $75 cash payout, which will be increased or decreased depending on what funds remain after out-of-pocket expense payments and the payment of attorneys’ fees, service awards and administration fees.
Moreover, as part of the agreement, Hilb Group will also take measures to enhance its cybersecurity and better secure its computer systems, the website adds.
Hilb Group settlement payouts will be issued to qualifying class members only if the deal is granted final approval by the court at a hearing on February 3, 2025. The final approval process may be delayed by appeals that must be resolved before payments can be distributed to eligible consumers, the site notes.
The lawsuit against Hilb Group alleged that negligence on the company’s part resulted in the cyberattack, during which an unauthorized third party reportedly gained access to certain employee email accounts for a limited period between December 2022 and January 2023. Per the class action suit, the incident compromised individuals’ names, addresses, Social Security numbers, financial account information, driver’s license or state ID data, passport details and other sensitive information.
