The One Brooklyn Health class action settlement covers all United States residents whose personal information may have been compromised, accessed or involved in the data security incident, which the healthcare system says occurred between July 9 and November 19, 2022.

Class members have until March 10, 2025 to file a claim form online or by mail for settlement benefits.

According to court documents, covered individuals who file a valid, timely claim are eligible for reimbursement of up to $2,500 for documented out-of-pocket losses incurred as a result of the One Brooklyn Health data breach. Class members can also submit a claim to get compensation for up to four hours of lost time spent dealing with the effect of the breach at a rate of $25 per hour.
Class members are also eligible to file a claim for 24 months of credit monitoring and identity theft protection services free of charge.
As an alternative to the foregoing benefits, class members can file a claim for a pro-rated cash payment.
The court granted preliminary approval to the settlement in November 2024, and a final approval hearing was held on February 26, 2025. Settlement benefits will be distributed to eligible class members if final approval is granted and after any appeals are resolved.
The initial One Brooklyn Health class action lawsuit alleged that an unauthorized individual was able to access files within the defendant’s inadequately secured computer systems. Per the complaint, the cyberattack exposed patients’ names, Social Security numbers, driver’s license or state identification numbers, dates of birth, financial account information, medical information and health insurance details.
