$1.3M-Plus APS Settlement Resolves Data Breach Lawsuit Over November 2020 Cyberattack

Automation Personnel Services faces a class action over a November 2020 data breach that reportedly compromised employees’ personal information.
Automation Personnel Services, Inc. (APS) has agreed to pay a more than $1.3 million settlement to resolve a proposed class action lawsuit that claimed the staffing agency failed to protect employees’ personal information during a November 2020 data breach.

The $1,375,000 deal, which was granted preliminary approval by the court on August 26, 2024, covers anyone in the United States or its territories whose personal information was potentially impacted in the November 2020 data security incident that APS announced in March 2021.
APS provided notice of the data breach to 299,253 people, the settlement agreement shares.
Only class members who submit a valid claim form online or by mail by December 24, 2024 will be eligible to receive APS settlement benefits.

As part of the deal, eligible class members may file a claim for up to $5,000 per person for out-of-pocket costs that are reasonably linked to the data breach and supported by documentation, the settlement website relays.
Per the site, class members may also receive reimbursement for up to four hours of lost time spent remedying issues related to the incident, at a rate of $20 per hour.
In addition, consumers who submit a valid claim form by the deadline may be eligible to receive one year of complimentary credit monitoring services, the website says.
According to the site, APS settlement benefits will be issued only if the court grants final approval to the terms of the deal, and after any appeals are resolved. A final approval hearing is scheduled for February 6, 2025 in Alabama.
The lawsuit against APS alleged that the company negligently failed to implement adequate cybersecurity protocols, which left employees’ private data vulnerable to unauthorized third-party access. The data breach lawsuit contended that even though the incident occurred in late November 2020, the company did not begin to notify impacted individuals until mid-March 2021, which the suit argued exposed victims to a heightened risk of identity theft and fraud.
