A proposed class action lawsuit alleges Ingenuity Dream & Grow Bedside Bassinets have a design defect that can put babies at risk of suffocation—and attorneys working with ClassAction.org now need parents to come forward to help strengthen the case.
The lawsuit claims the bassinets do not stay level, which can cause a baby to roll from their back onto their side or stomach and potentially suffocate. Incident reports submitted to the Consumer Product Safety Commission (CPSC) show that the Ingenuity Dream & Grow Bedside Bassinets’ allegedly defective design has been linked to at least two infant deaths and seven “close calls,” the class action says.
Safety experts at Consumer Reports have since called for the products to be recalled, but none have been issued to date.
Now, the attorneys want to speak with people who have bought an Ingenuity Dream & Grow Bedside Bassinet within the past three years and live in Florida, California, New York, Illinois, Missouri, Georgia, Massachusetts, Washington or Virginia.
Ingenuity Bassinets Linked to Infant Death, Lawsuit Says
According to the American Academy of Pediatrics, infants should always be placed on their backs to sleep, on a firm and flat surface. Placing babies on their stomachs to sleep can significantly increase their risk of sudden infant death syndrome.
Importantly, the Kids2 lawsuit claims Ingenuity Dream & Grow Bedside Bassinets are cantilevered, meaning that they are supported on only one side. This design flaw can cause the bassinet’s sleep surface to tilt when weight is applied, which puts infants at risk of rolling from their back into dangerous and potentially fatal sleeping positions, the case says.
The complaint notes that since 2019, the CPSC has been notified of at least five infant deaths related to bassinets with a cantilever design.
Two of these instances involved an Ingenuity Dream & Grow Bedside Bassinet. Per the filing, a four-month-old boy died in August 2019 and a one-month-old girl died in January 2022 after they were put down to sleep on their backs in the bassinets and were later found on their stomachs.
The class action lawsuit claims Kids2 has known of the alleged defect since at least 2018 from the sheer volume of negative online reviews and CPSC complaints it has received from bassinet buyers but has done nothing to address or warn parents of the “unreasonable” safety hazard the products pose to infants.
