Problems with DePuy Hip Implant Reimbursement?

Some consumers are reporting considerable problems with the compensation packages offered due to the extensive failures of DePuy Orthopedics artificial hip implants. The New York Times and other news outlets have reported that DePuy’s compensation packages do not cover nearly all of a patient’s related medical bills, do not include money for pain and suffering, ignore long-term injury to the body, force patients to sign away some of their legal rights, and take far longer to materialize than they should.

DePuy, a subsidiary of pharmaceutical giant Johnson & Johnson, is dealing with problems with multiple of their artificial hips, including both the ASR and the Pinnacle. The DePuy ASR (Articular Surface Replacement) metal-on-metal hip implant was first offered in the United States 2005, but was recalled in August 2010 after reports of higher-than-expected failure rates and possible metallic poisoning. Over 1,000 lawsuits and complaints have been filed about the ASR. In addition, DePuy faces over 560 lawsuits related to its all-metal Pinnacle hip plant.
In order to pay out the compensation packages for the faulty devices, Johnson & Johnson hired risk management firm Broadspire. In a letter, DePuy said that they intended "to cover reasonable and customary costs of monitoring and treatment for services, including revisions, associated with the recall of ASR." Because these costs were vague and undefined, it is believed that patients may not be receiving the quality of care, response, and compensation they deserve.
In general, many patients believe they are not receiving the amount of compensation that they would be able to fight for if they hired an attorney. Due to the serious side effects of the faulty DePuy ASR and Pinnacle hip replacement devices, many patients are allegedly being insufficiently compensated by Johnson & Johnson and Broadspire as the compensation program does not allow for the recovery of pain and suffering and future medical bills, among other damages.
