Vizio Settles False Advertising Class Action
Vizio has agreed to pay $2.3 million to settle a proposed class action that claimed the company deceived its customers by advertising Amazon Instant TV access on its sets months before the service actually became available. Customers complained that they bought Vizio smart TVs under the impression that the streaming service would be available immediately. More than 200,000 people may be able to claim a part of the settlement, which will provide Amazon streaming credits.
Genentech Accused of Lying About Cancer Meds
Genentech has been accused of lying about the amount of breast cancer medication actually included in a given dosage of a popular cancer drug. According to the complaint, hospitals were deceived when Genentech allegedly put less medication (Herceptin) in the bottles than it claimed – or when the company lied about the concentration of the drug when it was to be added to a solution. The proposed class action also claims that if the concentration is off, hospitals are unintentionally giving patients higher doses than they need.
Fresh Market Settles Wage and Hour Lawsuit
Fresh Market has agreed to a $5 million settlement deal, putting to rest claims that it failed to properly pay its department managers. Close to 2,000 department managers who were allegedly deprived of overtime pay will be able to claim a part of the settlement. The suit claimed that instead of paying the managers time-and-a-half, the grocer paid them half-time.
Dollar General Sued for Marketing Obsolete Motor Oil
Dollar General has been hit with a proposed class action claiming that it sold obsolete motor oil that can damage certain vehicles. The lawsuit says that the DG Auto SAE 10W-30 and 10W-40 motor oils are only suited for vehicles made before 1988 and, if used in newer models, will actually damage the engines. It doesn’t help that the only warning customers get is in small black print on the back label. According to the complaint, this is misleading because at a glance, the only apparent difference between Dollar General branded motor oil and other brands is a smaller price tag – which could be misleading to consumers.
RushCard to Reimburse Customers for Card Outages
RushCard has agreed to pay $20.5 million to reimburse customers who couldn’t access their prepaid card accounts back in October. The settlement will award up to $500 to RushCard users who were locked out of their accounts.
