Lawsuit Says Hostess “Maple Glaze” Claims Are Deceptive
Hostess Brands has been hit with a proposed class action lawsuit that claims the company falsely advertises its Donettes Maple Glazed Mini Donuts. According to the complaint, the product’s label is defective and violates the Food, Drug and Cosmetic Act because the donuts don’t actually contain any maple. The lawsuit aims to get Hostess to stop labeling its donuts as having a “maple glaze” when they don’t contain maple sugar or maple syrup.
CVS Looks to Settle False Advertising Lawsuit
CVS Pharmacy has agreed to settle a class action that claims its algae supplement doesn’t improve memory like its packaging suggests. The settlement hasn’t been approved by a judge yet, but it would offer $4 in cash or a $6.50 voucher to nearly 200,000 people who bought CVS’ Algal-900 DHA dietary supplement.
Quest Diagnostics Settles Wage and Hour Suit with Blood Techs
Quest Diagnostics’ proposed $2.4 million settlement with its phlebotomists was granted preliminary approval on Tuesday. According to the lawsuit, the blood technicians were forced to work overtime due to understaffing, but weren’t paid properly for the extra work. The settlement, if granted final approval, will compensate close to 2,600 Quest employees.
DirecTV FLSA Lawsuit Heads to Trial
A lawsuit between DirecTV and a group of its technicians is set to go to trial. The lawsuit claims that DirecTV violated the Fair Labor Standards Act by misclassifying its workers as independent contractors so it could avoid paying them overtime. The trial is set to take place on July 19th – if the case doesn’t reach a settlement before then.
Fiat Chrysler Agrees to Stop Using Takata Airbags
Fiat Chrysler Automobiles (FCA) has announced that it will stop installing Takata’s potentially dangerous airbags in its cars by sometime next week. FCA also said that it will let its customers know if they buy a vehicle with a Takata airbag already installed – and that they should be ready for a recall. Reportedly, the 2016 Jeep Wrangler is the only unsold vehicle that still has the airbags installed.
Five Guys Accused of Gender Discrimination
Five Guys Operations is facing a proposed class action claiming that it pays its female employees less than men performing the same job. Named plaintiff Jody Finefrock says that even though she workedseveral positions at the restaurant with notable success and promotions, she was consistently paid less than her male counterparts. According to the complaint, Five Guys violated the Equal Pay Act and should compensate its female employees for their unfair treatment.
Hair Relaxer Lawsuits
Women who developed ovarian or uterine cancer after using hair relaxers such as Dark & Lovely and Motions may now have an opportunity to take legal action.
