Lumber Liquidators & the CDC's Findings

The Centers for Disease Control and Prevention (CDC) released some startling information on Monday. It appears the findings they previously reported from their Lumber Liquidators investigation were incorrect. The investigation began in the wake of the formaldehyde scandal last year and, earlier this month, the CDC reported that the cancer risk from the Chinese-made flooring wasn’t high enough to cause much concern. Unfortunately, there was a mistake with their calculations and the actual risk for cancer is three times higher than they previously thought.
Does This Affect the Current Litigation?
The litigation covered on ClassAction.org and other places is primarily concerned with compensating individuals for purchasing a defective product, not for any injuries they’ve sustained. The CDC’s findings likely won’t change the class action litigation going forward because the new information doesn’t change the claims that have already been made against Lumber Liquidators. All in all, from a legal perspective, not much has changed since our last update.
Can’t We Do Anything Else?
If you are looking for compensation for bodily harm potentially caused by the flooring, you would likely need to file an individual lawsuit. Before you pursue an individual lawsuit, you should contact a reliable attorney in your area who would be able to help you figure out what legal standing you have on an individual basis.
Aside from what can be done legally, the CDC has provided some practical information for anyone who may have the affected flooring in their homes. The info from the CDC covers things you can do to reduce formaldehyde exposure, whether or not you should get your flooring tested or removed, and what to do if you have symptoms. On a personal note, I know this is a hard thing to go through. I’ve spoken to many of you who feel betrayed because of what has been going on over the past year and it’s a shame that findings like these further validate that feeling.
