Class Action Lawsuit Filed Against The Weather Channel

A federal class action lawsuit has been filed against The Weather Channel. The lawsuit claims that The Weather Channel repeatedly sent people spam text messages, despite being asked to stop. If true, The Weather Channel would be violating the Telephone Consumer Protection Act. The suit took shape when one of the plaintiffs, Michael Rossell, replied to a spam text “stop.” Despite having rescinded any prior consent for The Weather Channel to send texts, they sent him another one and billed him for it, according to the allegations.

The Weather Channel could be liable for a significant amount of money if the allegations of the lawsuit prove to be true. Violating the TCPA carries a $500 fine for every violation. The class action case against The Weather Channel is being brought on behalf of everyone in the U.S. and its territories who have received one or more unauthorized text messages from the Weather Channel. According to reports, the lawsuit is seeking an award of damages both actual and statutory, as well as an injunction that would force The Weather Channel to cease all alleged spam activities.
The Telephone Consumer Protection Act was passed by Congress in 1991. The law was essentially created to protect consumer privacy and regulates when and under what circumstances solicitors are allowed to contact consumers. The law is also very clear that it’s within the consumer’s rights to choose not to be contacted by solicitor. The TCPA states that violators may be sued for up to $1,500 for each violation or to require actual monetary loss.
