AT&T Data Throttling Suit Heads to Arbitration

AT&T was hit with a proposed class action claiming that AT&T misled its customers when advertising its unlimited mobile data plan, but the case has since been sent to arbitration. A clause in AT&T’s contract said that if there were legal disputes with regard to its service, customers would be required to seek compensation through individual arbitration – and not through a class action. The court agreed with the contract agreement stating that adhering to the agreement doesn’t violate the plaintiffs’ First Amendment rights since they are not filing a lawsuit against the government.
