The four-page Eli Lilly lawsuit was filed by a California resident who takes Zepbound, an injectable prescription medication used for weight management and other health conditions. The class action suit claims that beginning in February of this year, mismanagement of Eli Lilly’s supply chain meant that Zepbound became “widely unavailable” to patients, leaving them without access to their medication.
According to the case, the supply shortages and interrupted treatments have caused patients like the plaintiff to experience emotional distress, financial burdens and negative health consequences such as weight gain, worsening of underlying conditions and increased anxiety and stress.
Eli Lilly had a duty to properly manage its supply of Zepbound to ensure the medication was accessible to patients who rely on it, the complaint contends.
Despite being aware of the shortages, the company has “failed to provide patients or healthcare providers with adequate warnings, alternative treatment options, or guidance on managing the sudden treatment interruptions,” the filing charges.
The suit alleges that Eli Lilly has wrongfully profited from the sale of Zepbound at the expense of patients, who were prescribed the medication with the expectation that it would be supplied regularly and without interruption.
The lawsuit against Eli Lilly looks to represent anyone in the United States who was prescribed Zepbound for weight management or other medical conditions and experienced an interruption or discontinuation of treatment due to supply shortages.
