A New York woman has filed a proposed class action lawsuit against Windham Professionals, Inc. after the debt collector sent her an allegedly misleading collection letter that she claims violated the Fair Debt Collection Practices Act (FDCPA). The notice, according to the suit, informed the plaintiff that she should “send all correspondence” to a mailing address. This statement allegedly implied that any disputes must be made in writing and cannot be made over the phone, which the suit argues contradicts the plaintiff’s FDCPA rights.
